| Constitutional crisis in Ireland! Constitutional crisis in the Republic of Ireland! Irish High Court decrees that special Dail Parliamentary inquiry committees , set up to investigate complaints and controversies involving the Irish Police and Justice Dept , are unlawful! The appeal was submitted to the Irish High Court by 36 low ranking serving Garda who claimed that the Dail Committees do not have the right under Irish law to investigate cases such as the shooting of John Carthy and interview individual members of the Garda . They also claimed that the committeees could adversely affect the reputations of individual members of the Irish police force who were on duty at Abbeylara on the day when John Carthy was shot!
The Dail Committees were set up after massive public outcry surrounding the Garda's handling of the investigations into the shooting of John Carthy at Abbeylara in April 2000 by the Garda Emergency Response Group. The Garda were forced to set up inquiries into the shooting of John Carthy after a massive public outcry. The Garda then appointed several high ranking Garda to look into the shooting but it's findings were not accepted by members of John Carthy's family who demanded a full public inquiry. The Garda again stalled when they engaged the FBI to give a second opinion on the John Carthy shooting. The result was the expected whitewashing of Irish Garda handling of the Abbbeylara incident! This was the second time the Garda called in the FBI. The first occasion was when they came under pressure for their bungling of the investigations of the large numbers of Irish missing persons. The ruling by the high Court Judges on the Dail Committees powers to investigate ANY controversial cases has thrown a spanner into the workings of the Dail and many of it's members into a state of uncertainty and confusion . There are now question marks over the legality of other Dail Committee inquiries which are already well under way. A spokesman for the Dail Committees , Alan Shatter Fina Gael TD , said that many other countries have special committees made up of elected representatives who investigate cases involving state police and secret service depts . One example is the US State Special Investigatory Senate Committees which exposed, in 1977 , the CIA Born Again involvement with the Contras in Nicaragua and the scandal of the BCCI Bank . Mr Shatter said the ruling threatened a constitutional crisis in the state and unless it was rectified quickly , a referendum would have to be put before the Irish people to change the law in favour of special parliament committees . The current crisis , brought about by the failure of the Justice Dept and the Irish Garda to behave in a complete and transparent manner in all matters , is only the latest in a long list of complaints which are being laid at the doors of the Garda and Justice Dept. Apart from the Abbeylara case , there is the huge issue of the high number of Irish missing persons in the state which no TD to date has acknowledged as a problem and seriously debated in the chamber! They have debated individual missing persons cases but never the NUMBER of Irish missing people! Why not? There is also the McBrearty case in Donegal which is a time-bomb waiting to go off! Unless the Irish people begin to see complete openness and transparency on the part of the Garda and Justice Depts , great unease will spread through Irish society and people will begin to see the police and judiciary as the enemy who are behaving in an unlawful manner !
